1. Introduction

Welcome to ThrivePal! By downloading, installing, or using the ThrivePal mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms govern your use of our habit tracking and productivity services.

ThrivePal is designed to help you build better habits, track your productivity, and achieve your goals. By using our App, you acknowledge that you have read, understood, and agree to these Terms.

2. User Accounts & Responsibilities

Account Creation

To access certain features of ThrivePal, you may need to create an account. You are responsible for:

• Providing accurate, current, and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Acceptable Use

You agree to use ThrivePal only for lawful purposes and in accordance with these Terms. You may not:

• Use the App to violate any laws or regulations
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Share your account credentials with others
• Use the App for commercial purposes without permission

3. Premium Features & Purchases

Free vs. Premium

ThrivePal offers both free and premium features. Premium features may include:

• Advanced habit analytics and insights
• Unlimited habit tracking
• Cloud backup and synchronization
• Priority customer support
• Custom habit templates and challenges

Premium plans

Premium access is sold through in-app purchases on the App Store or Google Play. Available plans include:

• Yearly: An auto-renewing subscription billed annually until you cancel. A free trial may be offered when available from the store.
• Weekly: An auto-renewing subscription billed weekly until you cancel.

Prices and any trial terms are shown in the app at purchase. Regional pricing may vary. Legacy Lifetime (one-time) purchases remain valid for existing buyers and do not auto-renew.

Subscription terms

If you choose a Yearly or Weekly subscription, you agree to:

• Pay the subscription fee shown at checkout
• Allow automatic renewal unless canceled before the renewal date
• Provide valid payment information through your App Store or Google Play account
• Cancel at least 24 hours before renewal to avoid the next charge

4. Payments & Refunds

Subscriptions (Yearly and Weekly)

Yearly and Weekly premium are auto-renewing subscriptions. Fees are charged according to the plan you select at the price shown in the app. You can cancel before renewal to avoid future charges through your App Store or Google Play account settings.

Legacy Lifetime (one-time purchase)

Lifetime premium (where previously purchased) is a single, non-recurring charge processed by Apple or Google. You will not be billed again for Lifetime access unless you purchase another product. Refunds for Lifetime purchases follow the App Store or Google Play refund policies and our support review process.

Refund Policy

We want you to be satisfied with ThrivePal. Refund requests are handled as follows:

• Subscriptions: Full refund within 30 days of charge where applicable, subject to App Store / Google Play rules
• Legacy Lifetime: Contact support within 30 days of purchase; refunds are subject to App Store / Google Play rules
• After Refund Window: No refunds available except as required by store policy or law

5. Privacy & Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy principles:

• Your habit data stays primarily on your device
• Cloud backup is optional and encrypted
• We don't sell or share your personal data
• You control what information you share

6. Intellectual Property

ThrivePal and all related content, including but not limited to the App, software, design, text, graphics, and logos, are owned by us or our licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use ThrivePal for personal, non-commercial purposes in accordance with these Terms.

7. Disclaimers & Limitations

Service Availability

We strive to provide reliable service, but ThrivePal is provided "as is" without warranties. We do not guarantee:

• Uninterrupted or error-free operation
• Compatibility with all devices or operating systems
• Specific results from using the App
• That the App will meet all your requirements

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of ThrivePal.

8. Prohibited Activities

You may not use ThrivePal to:

• Track illegal or harmful activities
• Harass, abuse, or harm others
• Violate intellectual property rights
• Attempt to reverse engineer the App
• Use automated systems to access the App

9. Updates & Changes

App Updates

We may update ThrivePal from time to time to improve functionality, fix bugs, or add new features. Updates may be automatic or require your action.

Terms Updates

We may modify these Terms at any time. Significant changes will be communicated through the App or email. Continued use after changes constitutes acceptance of the new Terms.

10. Governing Law & Disputes

These Terms are governed by the laws of the United States. Any disputes will be resolved through good faith negotiations. If resolution cannot be reached, disputes may be subject to binding arbitration.
